The Terms and Conditions (“Terms”) contained herein and the amendments thereto shall govern the use of our website (“Website”). By accessing or using this Website (other than reading these Terms for the first time), it represents that you have read, understood and agreed to comply with all the Terms hereof. If you do not accept these Terms, please immediately discontinue your access to this Website and/or use of the services.
  1. DEFINITIONS

    1. 1.1 "Content" refers to any text, graphics, images, audio, video and any other material published on the Website.
    2. 1.2 "Website" refers to any of the domains owned by Lemmy through which Lemmy allows the Users to use or browse.
    3. 1.3 "User" refers to any person who uses the website owned by Lemmy.
    4. 1.4 "Tenant" refers to the person requesting a tenancy for the properties via the Website or services and/or who is residing at a Property and who is not the Owner of the same Property.
    5. 1.5 "Owner" refers to the individual or entity engaged in an agreement with Lemmy to advertise properties on the website, facilitating tenancy by Tenants. Owners may include individuals, legal entities, or any entity authorized to enter into lease agreements for medium to long-term periods with Lemmy. By registering and listing a Property, you confirm Ownership or possess legal authority to lease it.
    6. 1.6 “Agent” refers to the individual or any entity authorized to act on behalf of Owners to Advertise a Property.
    7. 1.7 "You" or “your” refers to the User, Tenant or Owner (as appropriate).
    8. 1.8 "Advertisement" refers to the publishing of a listing of the Property on the website by the Owner, in order that it is made available for booking on the Website.
    9. 1.9 "Property" refers to the apartment, condominium, landed properties or room included in the Advertisement that the Owner publishes on the website, in order that the Tenant may make an online booking.
    10. 1.10 “Verified” refers to a Property that has been verified physically by Lemmy’s representative.
  2. THIRD-PARTY LINK AND CONTENT

    If you click on a link to a third-party site, you will be taken to websites we do not control. While we try to be proactive and ensure that appropriate protections are in place, we cannot be responsible for the Terms used by other website Owners or the Content or accuracy of those other websites. Please read the Terms of other websites carefully. We will not be liable for any loss or damage caused by your reliance on information obtained through third-party sites.

  3. LAWFUL PURPOSE

    You may use this Website for lawful purposes only. Transmission and/or posting of any material in violation of any international, Federal, State or Local regulations are prohibited. This includes, but is not limited to copyrighted materials, material legally deemed to be threatening or obscene, pornographic, profane or material protected by trade secrets or which, without Lemmy’s express prior approval, contains advertising or any solicitation with respect to products or services or membership or subscription to other online information services competitive with Lemmy’s Website. This also includes links or any connection to such materials. Any conduct in Lemmy’s view that restricts or inhibits any other Lemmy Website User from using or enjoying the Website will not be permitted.

  4. COPYRIGHTS AND TRADEMARKS

    We own solely and exclusively all rights to the Content, including but not limited to text, graphics, logos, buttons, icons, images, video, music, sound, copyrights, trademark rights, patent rights, database rights, moral rights, sui generis rights and other intellectual property and proprietary rights therein on this website. No part of the Content of this website may be used, published, transmitted, modified, transferred or sold, created as derivative works or in any way exploited without express permission from Lemmy and the respective copyright Owners. You may download materials for personal use only provided that it is not for the purpose of private or commercial gain.

    All Trademarks not owned by us that appear on this Website are the property of their respective Owners. Nothing contained on this Website should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed on this Website without our written permission or the third party that may own the applicable Trademark.You shall not upload, post or otherwise make available on this Website any material protected by copyright, trademark or other proprietary right without express permission of the respective Owners. You shall be solely liable for any damages resulting in any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting materials to any public area of this Website, you automatically grant, or warrant that the Owner of the material expressly grants Lemmy rights and licenses to use, reproduce, modify, adapt, publish, translate and distribute such material in whole or in part. You also permit any other Users of this Website to access, view or store the materials for their own use. You also grant Lemmy the right to edit, copy, publish and distribute any material that you have made available on Lemmy's Website.

    You understand and agree that use of this Website is at your sole risk. Neither Lemmy, its employees, agents, third party Content providers or merchants warrant that this Website will be uninterrupted, error free or free from viruses or other harmful components nor do they make any warranty as to the result that may be obtained from the use of Lemmy’s Website, or as to the accuracy, reliability or content of information, service or merchandise provided by Lemmy’s Website. that may infect your equipment on account of your access to, use of, or browsing in Lemmy’s Website or your downloading of any materials, data, text, images, video content, or audio content from Lemmy’s Website. If you are dissatisfied with Lemmy’s Website, your sole remedy is to discontinue using Lemmy’s Website.

    In no event shall we be liable for any direct, indirect, incidental, punitive or other consequential damages or any damages for loss of profits, use, data, goodwill or other intangibles, arising from or in any way connected with these Terms, the use of Lemmy’s Website or the materials, the licensed marks, or any information, goods or services obtained on or from Lemmy’s Website, whether or not Lemmy is advised of the possibility of such damages.

  6. INDEMNIFICATION

    You agree to defend, indemnify, save and hold Lemmy, its employees, agents, third party Content providers or merchants harmless from and against any demands, liabilities, losses, costs and claims, including reasonable attorneys’ fees, that may arise or resulting from the use of Lemmy’s Website or your breach or violation of these Terms. You shall use your best efforts to cooperate with us in the defence of any claim.

  7. PROPERTY LISTING

    The Owner or Agent shall provide all the necessary information to create his/her advertisement on the website, which includes, but not limited to, the Property’s location, capacity, size, features and availability, including the price and all that pertaining to the payment terms. All information relating to the Property  including the payment terms published in the Advertisement, shall always be determined by the Owner or Agent and at his sole discretion.

    The Owner or Agent declares and accepts that all the information provided on the Platform is true, correct and updated. The Owner or Agent shall provide without undue delay any kind of document requested by Lemmy for the purpose of verifying Ownership of the Property or compliance with any other legal or contractual requirements.

    The Owner acknowledges and accepts that once the Tenant makes a reservation for the Property, the price of this reservation cannot be amended.

    Owner shall maintain the Property in a similar condition to that depicted in the Advertisement. In the event that the conditions of the Property differ significantly from those of the Advertisement, Lemmy reserves the right to withdraw the Advertisement for such Property from the website, for breach of these Terms.

    In the event of any discrepancies existing between the Content of the Advertisement and Lemmy's Terms, the latter shall prevail. Lemmy reserves the right to deny the publication of an Advertisement which, at its sole discretion, breaches or does not comply with these Terms.

    Lemmy shall be entitled to refuse registration on the website to any User, Owner or Tenant, at its discretion and without prior notice.

    Lemmy will remain the Owner of all copyrights or any other intellectual property for the audiovisual and advertising material and only Lemmy holds the rights for its use. In the event that the Owner, or a third party, uses such material owned by Lemmy without having written consent to do so, Lemmy reserves the right to demand the cessation of the use of such material as well as to additionally claim the corresponding damages and/or indemnity as a result of non-compliance with this clause.

    By publishing the Advertisement on the Website,  the Owner expressly acknowledges and agrees that the Advertisement will be included on every internet domain belonging to the Lemmy and that it may also be featured, in order to maximise the spread of the Advertisement, on third-party websites external to the Lemmy.

    The User hereby acknowledges that Lemmy is not responsible for any Content written / created by the Tenant or Owner, therefore Lemmy shall not be held liable for any actions committed by them.

  8. MONITORING

    We reserve the right, but do not have an obligation, to monitor and/or review all materials posted to Lemmy’s Website by Users, and we are not responsible for any such materials posted by Users. However, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or Governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, that in our sole discretion are objectionable or in violation of this Terms, our policies or applicable law.

  9. REFUND

    All refund requests are subject to approval. Refunds will be processed within 30 days of the approval of your request. We aim to ensure a fair and efficient process for all refund requests, and our team will carefully assess each case to determine eligibility. For inquiries or assistance with refund requests, please contact our rental manager.

  10. TERMINATION

    Both parties may terminate these Terms at any time. Without limiting the foregoing, Lemmy shall have the right to immediately restrict, suspend or terminate your access to Lemmy’s Website and/or its services in the event of any conduct by you, which Lemmy, in its sole discretion, consider to be unacceptable, or in the event of any breach by you of this Terms.

  11. GOVERNING LAW

    These Terms and any operating rules for Lemmy Website established by Lemmy constitute the entire agreed Terms of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements or agreed Terms between the parties with respect to such subject matter. These Terms shall be construed in accordance with the laws of Malaysia and the parties agree to submit to the exclusive jurisdiction of the courts of Malaysia for the purpose of hearing and determining any dispute arising out of these Terms. Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

    We do not represent that materials on this Website are appropriate or available for use in locations outside Malaysia. If you access this Website remotely from outside Malaysia, you do so on your own initiative, and you are responsible for compliance with the local laws, if and to the extent local laws are applicable. All parties to this Terms waive their respective rights to a trial by jury

  12. CHANGES TO TERMS OF USE

    We reserve the right to modify these Terms at any time in our sole discretion with or without notice, which shall be effective immediately. We encourage you to periodically read these Terms to see if there have been any changes that may affect you. If the modification to these Terms is unacceptable to you, please immediately discontinue your access to this Website and/or use of the services.

  13. REFERRAL PROGRAMME TERMS AND CONDITIONS

    1. 13.1 Eligibility

      Only current customers of Lemmy (both Tenants and homeowners) and members of Lemmy's corporate partners (as decided and recognised by Lemmy under its partnership programme) are eligible to participate in the Referral Programme.

    2. 13.2 Referral Bonus

      Both the referrer and the referee are entitled to a referral bonus of RM250 upon successful completion of the following conditions:

      1. A Tenant, as referred by the referrer, is successfully placed in a rental Property managed by Lemmy; OR

      2. A homeowner, as referred by the referrer, has a Tenant successfully placed in their Property managed by Lemmy.

    3. 13.3 Payment Conditions

      Referral bonuses will be paid out only after 3 months from the start date of the tenancy provided there have been no reported issues during this 3-month period.

    4. 13.4 Referee Eligibility

      To qualify for a referral bonus, the person referred must:

      1. Be entirely new to Lemmy upon sign-up.

      2. Not have been referred to Lemmy by another individual.

      3. Not have had any previous communication or negotiation with any member of the Lemmy team.

      4. Sign up to Lemmy with a Property that isn't already under discussion or association with another party or Owner that has engaged Lemmy regarding the same Property.

    5. 13.5 Referral Limits and Multiplicity

      A referrer can earn multiple referral bonuses for every new Tenant and every new homeowner they successfully refer to Lemmy. However, referrers will earn only one referral bonus per referred homeowner, even if that homeowner signs up multiple properties with Lemmy.

    6. 13.6 Referral Verification

      Bonuses will only be awarded for referrals that:

      1. Can be verified as genuine and legitimate by Lemmy.

      2. Were made known to Lemmy either before or concurrently with the referred person's sign-up.

    7. 13.7 Exclusions

      Self-referrals will not be entertained or rewarded under this programme. Lemmy maintains the right to disqualify any referral bonuses earned through methods that are deemed fraudulent, illegal, or in any way abusive.

    8. 13.8 Right to Amend

      Lemmy expressly reserves the right to change, modify, or revoke the terms of service for this referral programme at any given time without prior notice.

    9. 13.9 Final Decision

      All decisions made by Lemmy concerning the Referral Programme are final and binding. By participating in the Lemmy Referral Programme, participants agree to be bound by these Terms.

  14. LEMMY REWARDS PROGRAMME TERMS AND CONDITIONS

    1. 14.1 Enrollment and Participation

      Any Tenant that rents a Property managed under Lemmy shall automatically be enrolled into the Lemmy Rewards Programme. Upon enrollment, Tenants may commence accumulating Lemmy Rewards points from qualifying transactions under the programme.

    2. 14.2 Nature of Rewards Points

      1. Lemmy Rewards points are non-transferable and are designated solely for the personal use of the Lemmy Tenant.

      2. Points bear no cash or monetary value, cannot be redeemed for cash, and cannot be purchased, resold, or transferred for value or otherwise.

    3. 14.3 Rewards & Benefits

      1. As a member of the programme, Tenants gain access to e-vouchers, discounts, promotions, free gifts, promotion codes, and other benefits provided by Lemmy and/or its third-party merchants. These benefits shall be enumerated in the rewards catalogue, which shall be updated from time to time and made available within the app or other official materials.

      2. Points may be utilised to claim services, such as but not limited to cleaning services, or to obtain rent cashback. Rent cashback can be claimed in vouchers of predetermined values which will be applied to the subsequent month's rent, contingent upon the Tenant having settled all due payments to Lemmy in a timely manner.

    4. 14.4 Points Accumulation & Redemption

      1. When Tenants complete certain qualifying activities, Lemmy shall award them points, which may then be redeemed for various rewards.

      2. Lemmy retains the right, at its sole discretion, to modify the rate at which points are awarded for each transaction. Such alterations may be communicated to the Tenant periodically.

      3. Tenants may not solicit Lemmy for the specific calculation methodologies employed in crediting points or any related matters.

      4. Points once redeemed for a Reward cannot be swapped for another.

    5. 14.5 Suspension & Conversion of Rewards Programme

      1. Lemmy reserves the right to temporarily suspend a Tenant's participation in the rewards programme under certain circumstances, such as but not limited to if the Tenant defaults on rent payments or faces eviction proceedings.

      2. Occasionally, Lemmy may offer conversion of Lemmy points to point systems of partner companies' reward programmes. Upon conversion of Lemmy points to these partner companies' points, reversals or reconversions will not be permitted. The conversion to partner entities' point systems shall be governed by the respective partner's Terms.

    6. 14.6 Liability and Errors

      1. Lemmy shall not be held liable for any inaccuracies in the crediting of points within the rewards programmes of partner companies, save for errors directly arising from Lemmy's own negligence.

    7. 14.7 Redemption Rejections and Points Issuance

      1. Lemmy, at its sole discretion and without any obligation to give prior notice, may reject a Tenant's request to redeem points for reasons including, but not limited to:

        1. Insufficiency of points for a particular reward.

        2. Non-availability or depletion of a reward by a third-party merchant.

        3. Points sought to be used were credited erroneously.

        4. Tenant's failure to effectuate timely payments, inclusive of rent and other services availed from Lemmy or its third-party associates.

        5. Suspicion by Lemmy of any illicit activity, fraudulent behaviour, or other misconduct concerning the redemption transaction.

      2. Lemmy may withhold the awarding of points until the relevant activity or transaction, inclusive of payment, reaches completion. Points stemming from purchases made with Lemmy's business partners or third-party merchants shall only be credited if the procured goods or services are neither returned nor cancelled and are fully paid for.

    8. 14.8 Fraudulent Activities and Modifications

      Engaging in fraud, misuse, or any dishonest activities concerning the Lemmy Rewards Programme may result in the forfeiture of accrued points.

      Lemmy retains the right, without any obligation for prior notice, to modify or amend the Terms of the Lemmy Rewards Programme, alter the number of points necessary for specific redemptions, replace any reward with another of approximate value, modify the qualifications or prerequisites for earning points, adjust the activities that accrue points, change the methods utilised for calculating awarded points, and institute or alter expiry dates for points, all at its sole discretion.

    9. 14.9 Final Decision

      All decisions made by Lemmy concerning the Rewards Programme are final and binding.By participating in the Lemmy Rewards Programme, Tenants agree to be bound by these Terms.
